1. Data processing on the website
1.1 Scope and purpose of the collection, processing and use of personal data
1.1.1 Log file when you access our website
When you visit our website, each access is temporarily stored in a log file. The following data is collected by us without your intervention and stored by us until automated deletion after twelve months at the latest:
- the IP address of the requesting computer,
- Date and time of access,
- Name and URL of the retrieved data,
- the website from which our domain was accessed,
- the operating system of your computer and the browser you are using,
- the name of your Internet access provider.
The collection and processing of this data is done for the purpose of enabling the use of the website (connection establishment), to ensure system security and stability on a permanent basis and to optimize the Internet offering, as well as for internal statistical purposes. The aforementioned information is not linked to or stored with personal data.
Only in the event of an attack on the network infrastructure of the website or a suspicion of other unauthorized or abusive website use will the IP address be evaluated for the purpose of clarification and defense and, if necessary, used in the context of criminal proceedings to identify and take civil and criminal action against the users concerned.
In the purposes described above, there is our legitimate interest in data processing within the meaning of Art. 6 (1) lit. f EU-DSGVO.

We use this data to activate the service you have requested and, if necessary for this purpose, to contact you by telephone and store it in our CRM database. The telephone number will not be used for marketing purposes under any circumstances. Our legitimate interest within the meaning of Art. 6 Para. 1 lit. f EU-DSGVO lies in processing your request. You can object to this data processing at any time (for contact details, see below), but you will then also not receive access to the more.
1.2 Cookies
Cookies help in many aspects to make your visit to our website easier, more pleasant and more meaningful. Cookies are information files that your web browser automatically stores on your computer's hard drive when you visit our website.
For example, we use cookies to temporarily store your selected services and entries when you fill out a form on the website so that you do not have to repeat the entry when you call up another sub-page. 1.3 Google Analytics
For the purpose of demand-oriented design and continuous optimization of our pages, we use the web analysis service Google Analytics from Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. In this context, pseudonymized usage profiles are created and small text files stored on your computer ("cookies") are used. The information generated by the cookie about your use of this website, such as • browser type/version • operating system used • referrer URL (the previously visited page) • host name of the accessing computer (IP address) • time of server request • areas of interest, • demographic data, • behavioral data, • geographical data, • device type, screen resolution, preferred language, • websites clicked on are transmitted to servers of Google, a company of the holding company Alphabet Inc, in the USA and stored there. In the process, the IP address is shortened by activating IP anonymization ("anonymizeIP") on this website before transmission within the Member States of the European Union or in other contracting states to the Agreement on the European Economic Area or Switzerland. The anonymized IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. In these cases, we ensure through contractual guarantees that Google maintains a sufficient level of data protection.
The information is used to evaluate the use of the website, to compile reports on website activity and to provide other services associated with the use of the website and the Internet for the purposes of market research and demand-oriented design of these Internet pages. This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of Google Inc. According to Google Inc., in no case will the IP address be associated with other data relating to the user.
Users can prevent the collection of the data generated by the cookie and related to the website usage by the respective user (including the IP address) to Google as well as the processing of this data by Google by downloading and installing the browser plugin available under the following link:

As an alternative to the browser plugin, users can click this link to prevent Google Analytics from collecting data on the website in the future. In doing so, an opt-out cookie is stored on the user's terminal device. If users delete cookies (see "Cookie" above), the link must be clicked again.
For the sake of completeness, we note that the U.S. authorities can carry out monitoring measures under U.S. legislation, in the context of which the general storage of all data forwarded from the European Union to the United States is possible. This is done without distinction, limitation or exception based on the objective pursued and without objective criteria that would make it possible to limit the access of the U.S. authorities to personal data and their subsequent use to specific, strictly limited purposes that would justify access to such data.
We would like to point out to users residing in a member state of the EU that, from the perspective of the European Union, the U.S. does not have a sufficient level of data protection - among other things, due to the issues mentioned in this section. To the extent that we have explained in this Privacy Policy that recipients of data (such as Google) are located in the U.S., we will ensure, either through contractual arrangements with these companies or by ensuring that these companies are certified under the EU-U.S. Privacy Shield, that your data is protected at an appropriate level with our partners.

1.4 Hubspot
We use Hubspot, a service of Hubspot Inc. based in the USA, on our websites for analysis purposes. This uses so-called "web beacons" and also sets "cookies" that are stored on your computer and enable an analysis of your use of the website by us. Hubspot analyzes the information collected (e.g. IP address, geographical location, type of browser, duration of visit and pages viewed) on our behalf in order to generate reports about the visit and the pages visited by us.
If you generally do not want Hubspot to collect data, you can prevent the storage of cookies at any time by changing your browser settings accordingly (see section 1.2 above).

1.5 Remarketing and conversion tracking
1.5.1 Google Remarketing and Conversion Tracking
In the area of "online marketing", we work together with the company Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, in order to recognize whether an Internet user has become aware of our website via a Google advertisement. Google uses "cookies" (see section 1.2 above), which are stored on your computer and allow an analysis of the use of the website. The cookies for the so-called "conversion tracking" are set when you click on an ad placed by Google. These cookies lose their validity after 30 days and are not used for personal identification. If you wish to deactivate these cookies for "conversion tracking", you can set your browser to block cookies from the domain "googleadservices.com". To prevent the execution of Java Script code from Google altogether, you can install a Java Script blocker (e.g.www.noscript.net or www.ghostery.com). In addition, we use Google Dynamic Remarketing from Google. For this purpose, Google uses what is known as a remarketing cookie, which enables your browser to be recognized when you visit other websites. The information generated by the cookie about your visit to our website (including your IP address) will be transmitted to and stored by Google on servers in the United States (for more information about transfers of personal data to the United States, see section 1.3).
Google will use this information for the purpose of evaluating your use of the website in relation to the advertisements to be displayed, compiling reports on website activity and advertisements for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. However, Google will not associate your IP address with any other data held by Google.
You can prevent remarketing by deactivating the corresponding cookie (see section 1.2).
In this data processing, we rely on a legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO. The possibility of objection / opt-out has been pointed out above.
1.5.2 Google Tag Manager
To manage the services for usage-based advertising, we also use the Google Tag Manager. The Tag Manager tool itself is a cookie-less domain and does not collect any personal data. Rather, the tool provides for the triggering of other tags, which in turn may collect data. If you have made a deactivation at the domain or cookie level, it will remain in place for all tracking tags implemented with Google Tag Manager.
1.5.3 eMailing Tool
We use your email addresses for email marketing purposes. We base this either on your consent according to Art.6 para. 1 lit. a DSGVO or, in the case of existing customers, on a legitimate interest according to Art. 6 para. 1 lit. f DSGVO. We will use your data for email marketing until you revoke your consent. You can revoke your consent at any time. You will find the contact details below in section 1.12. In addition, you will find an unsubscribe link in all newsletter emails.
We use third-party email marketing services (e.g. Hubspot, Mailchimp) for the dispatch. Our marketing emails may contain a so-called web beacon (tracking pixel) or similar technical means. A web beacon is a 1x1 pixel, non-visible graphic that is associated with the user ID of the respective email recipient.
For each marketing email sent, there is information about the address file used, the subject and the number of emails sent. In addition, it is possible to see which addresses have not yet received the e-mail, to which address it was sent and for which addresses the sending failed. In addition, there is the opening rate including the information which addresses have opened the e-mail. Finally, there is the information about which addresses have unsubscribed. We use this data for statistical purposes and to optimize the e-mails in terms of content and structure. This allows us to better tailor the information and offers in our emails to the individual interests of the recipients. The tracking pixel is deleted when the recipients delete the regarding email.
To prevent the use of the web beacon, please set your mail program so that no HTML is displayed in messages, if this is not already the case by default. On the following pages, you will find explanations on how to make this setting in the most common e-mail programs.
1.6 Storage of data in a central database
We store the data specified in section 1.1 ff. above in a central electronic data processing system. The data concerning you will be systematically recorded and linked for the purpose of processing your bookings and handling the contractual services. We base the processing of this data within the framework of the software on our legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO in customer-friendly and efficient customer data management. In addition, we base the processing of this data on the fulfillment of the contract within the meaning of Art. 6 para. 1 lit. b DSGVO.
1.7 Disclosure to third parties
We only pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship.
In addition, we pass on your data to third parties insofar as this is necessary in the context of the use of the website and the execution of the contract, namely the provision of the services requested by you as well as the analysis of your user behavior. The use of the data passed on for this purpose by the third parties is strictly limited to the aforementioned purposes.
Various third party service providers are explicitly mentioned in this privacy policy (e.g. in the sections "Tracking tools", "Remarketing").
A service provider to whom the personal data collected via the website is transferred or who has or may have access to it is our web hoster [Hostpoint AG, Neue Jonastrasse 60, 8640 Rapperswil-Jona, Switzerland]. The website is hosted on servers in Switzerland. The data is transferred for the purpose of providing and maintaining the functionalities of our website. This is our legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO.
1.8 Transfer of personal data abroad
We are entitled to transfer your data to third companies abroad if this is necessary in connection with the processing of your inquiries, the provision of services and marketing campaigns. These third companies are required to maintain the privacy of users to the same extent as the provider itself. If the level of data protection in a country is deemed inappropriate for Swiss conditions or in the sense of the EU General Data Protection Regulation, we ensure with the help of a contract that your personal data is protected at all times in accordance with Swiss guidelines or the EU General Data Protection Regulation. Various third-party service providers and their registered office addresses are already mentioned in the preceding section ("Transfer of data to third parties"). Some of the third-party service providers mentioned in this privacy policy are based in the USA (see "Tracking tools", "Remarketing"). 1.9 Right to information, correction, deletion and restriction of processing; right to data portability; right to complain to supervisory authority
You have the right to receive information about the personal data that we store about you free of charge upon request. In addition, you have the right to have incorrect data corrected and the right to have your personal data deleted, insofar as this does not conflict with a legal obligation to retain the data or an authorization that allows us to process the data.
You also have the right to demand that we return the data you have provided to us (right to data portability). Upon request, we will also transfer the data to a third party of your choice. You have the right to receive the data in a common file format.
You can contact us for the aforementioned purposes via the e-mail address Privacy.Policy@trafag.com. In order to process your requests, we may, at our discretion, require proof of identity.
You also have the right to complain to a data protection supervisory authority at any time.
1.10 Retention of data
We store personal data only as long as it is necessary to use the tracking services mentioned above as well as further processing within the scope of our legitimate interest. Contractual data is retained by us for a longer period, as this is required by legal retention obligations. Retention obligations that require us to retain data result from accounting regulations and tax regulations. According to these regulations, business communication, concluded contracts and accounting vouchers must be kept for up to 10 years. As far as we do not need these data any more for the execution of the services for you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.
1.11 Data security
We use appropriate technical and organizational security measures that we deem appropriate to protect your data stored by us from manipulation, partial or complete loss and unauthorized access by third parties. Our security measures are continuously adapted in line with technological developments.
We also take our own internal data protection very seriously. Our employees and the service companies commissioned by us are obliged to maintain confidentiality and to comply with the provisions of data protection law. Furthermore, they are only granted access to personal data to the extent necessary.
